Términos y condiciones del Servicio

Estos Términos regulan el uso del Servicio Striker Path. Al crear una cuenta o usar el Servicio aceptas estos Términos. Si no estás de acuerdo, no uses el Servicio.
1. Identificación del prestador

2. Objeto del Servicio
Striker Path es un videojuego en línea de progresión asíncrona ambientado en el fútbol, accesible desde navegador web y desde aplicación móvil iOS (y, cuando se publique, Android). El Servicio se presta "tal cual" en los términos descritos en estos Términos.
3. Cuenta de usuario
3.1. Requisitos
Para usar el Servicio necesitas:
- Tener al menos 16 años cumplidos. Si tienes menos de 16, no puedes registrarte ni usar el Servicio.
- Una dirección de correo electrónico válida.
- Aceptar estos Términos y la Política de privacidad.
3.2. Veracidad
Te comprometes a que la información que aportas (correo, nombre de usuario, datos de perfil) sea veraz. Si detectamos información manifiestamente falsa o que suplante a otra persona o entidad, podemos suspender la cuenta.
3.3. Custodia de credenciales
Eres responsable de mantener la confidencialidad de tu contraseña y de las acciones realizadas desde tu cuenta. Si sospechas un acceso no autorizado, escribe a legal@strikerpath.com.
3.4. Una persona, una cuenta
Cada usuario puede mantener una única cuenta. Las cuentas múltiples destinadas a obtener ventajas competitivas (intercambio de moneda virtual, ascensos artificiales, evasión de sanciones) están prohibidas y pueden ser canceladas sin reembolso.
4. Conducta aceptable
Al usar el Servicio te comprometes a no:
- Acosar, amenazar, insultar o difamar a otros usuarios.
- Usar lenguaje discriminatorio por razón de raza, género, orientación sexual, religión, nacionalidad o discapacidad.
- Compartir contenido sexual explícito, violento, ilegal o que vulnere derechos de terceros.
- Suplantar la identidad de otra persona, marca o institución.
- Hacer ingeniería inversa, descompilar, ofuscar el funcionamiento del Servicio o interferir con su infraestructura.
- Usar bots, scripts, automatizaciones, modificaciones de cliente o exploits para obtener ventajas no previstas por las reglas del juego.
- Comerciar con cuentas, monedas virtuales o ítems del juego fuera de los canales oficiales del Servicio.
- Recopilar datos de otros usuarios sin su consentimiento.
El incumplimiento de estas reglas puede dar lugar a advertencias, restricciones temporales, suspensiones o cancelación definitiva de la cuenta. La gravedad de la sanción es proporcional a la conducta y a su reincidencia.
4.1. Tolerancia cero con el contenido objetable
No toleramos contenido objetable ni comportamientos abusivos en ningún sitio donde los usuarios puedan escribirse. En concreto:
- Filtrado. Los mensajes, nombres, nombres de club y lemas se revisan automáticamente antes de guardarse, y el contenido que coincide con nuestra lista de bloqueo se rechaza.
- Reporte. Cada mensaje y cada perfil tienen una acción de reporte. Los reportes entran de inmediato en nuestra cola de moderación.
- Bloqueo. Puedes bloquear a cualquier jugador desde el propio mensaje. El bloqueo es mutuo: ninguno de los dos puede abrir ni escribir en una conversación con el otro, y dejas de ver sus mensajes en las salas compartidas. Puedes deshacerlo cuando quieras en Ajustes → Privacidad.
- Nuestro compromiso. Revisamos los reportes de contenido objetable y actuamos sobre ellos en menos de 24 horas, retirando el contenido y, cuando proceda, suspendiendo o expulsando al usuario que lo publicó.

5. Contenido del usuario
5.1. Tu contenido
Puedes generar contenido dentro del Servicio: nombre de usuario, nombre de personaje, configuración del avatar, escudo del club, mensajes en chat, reportes y feedback. Conservas la titularidad de ese contenido.
5.2. Licencia que nos otorgas
Para que el Servicio funcione (mostrar tu avatar a tus rivales, propagar tus mensajes, presentar tu club en el sistema de ligas), nos concedes una licencia mundial, no exclusiva, gratuita y revocable para alojar, copiar, mostrar y distribuir ese contenido estrictamente dentro del Servicio y de sus comunicaciones operativas. Esta licencia se extingue cuando suprimes el contenido o cierras la cuenta, salvo en lo necesario para fines legales (registros antifraude, copias de seguridad operativas) y por el tiempo estrictamente necesario.
5.3. Generación de contenido por inteligencia artificial
Algunas funciones (escudos generados por IA, retratos faciales) emplean modelos de inteligencia artificial. El resultado se ofrece tal cual, sin garantía de unicidad. Si nos pides retirar un escudo o retrato por similitud con una marca o persona, lo evaluaremos y, si procede, lo retiraremos.
6. Compras dentro del Servicio
6.1. Productos
El Servicio puede ofrecer:
- Suscripción premium: desbloquea funciones adicionales mientras esté activa.
- Moneda virtual (oro, gemas) y consumibles (potenciadores, cosméticos): tienen valor exclusivamente dentro del juego, no son convertibles a dinero real ni canjeables fuera del Servicio.
6.2. Procesador de pagos
En web los pagos se procesan a través de Stripe; en iOS y Android, a través de Apple App Store / Google Play (orquestados por RevenueCat). Aplican adicionalmente sus términos.
6.3. Derecho de desistimiento
Conforme al artículo 103.m del Real Decreto Legislativo 1/2007 (TRLGDCU), al descargar moneda virtual o contenido digital con ejecución inmediata, renuncias al derecho de desistimiento. Verás un aviso al confirmar la compra. Para suscripciones, dispones de 14 días naturales desde la contratación para desistir, siempre que no hayas comenzado a disfrutar de los contenidos; si has accedido a contenido premium durante el periodo de desistimiento, este se considera consumido.
6.4. Reembolsos
Los reembolsos se gestionan según las políticas del procesador de pago (Stripe, Apple, Google). Para incidencias atribuibles a Striker Path (cargo erróneo, transacción duplicada), escribe a legal@strikerpath.com en un plazo de 30 días desde la transacción.
6.5. Cambios en el catálogo y precios
Podemos modificar el catálogo, precios y ofertas. Los cambios no afectan a transacciones ya completadas. Si subimos el precio de una suscripción ya activa, te avisaremos con al menos 30 días de antelación y tendrás derecho a cancelar antes de la renovación.
7. Propiedad intelectual
7.1. Nuestro
Salvo el contenido del usuario y los componentes de software de terceros bajo sus respectivas licencias, todos los elementos del Servicio (código, diseño, ilustraciones, animaciones, música, marca, denominación, lema) son propiedad de Striker Path o de quienes los hayan licenciado al Servicio. No te concedemos derecho alguno sobre ellos más allá del uso necesario para disfrutar del Servicio según estos Términos.
7.2. De terceros
Si consideras que un contenido del Servicio infringe tus derechos de propiedad intelectual o industrial, escribe a legal@strikerpath.com identificando la obra, tu titularidad y el contenido reclamado.
8. Disponibilidad y modificaciones del Servicio
8.1. Disponibilidad
Hacemos esfuerzos razonables para que el Servicio esté disponible de forma continuada, pero no garantizamos un nivel concreto de disponibilidad. Pueden producirse interrupciones planificadas (mantenimiento) o no planificadas (fallos, ataques, fuerza mayor).
8.2. Modificaciones
El Servicio está en evolución activa. Podemos añadir, modificar o retirar funcionalidades, ajustar el balance del juego (estadísticas, recompensas, dificultad) y reescribir secciones de la experiencia. Estos cambios forman parte de la naturaleza de un servicio en evolución y no dan derecho a reembolso de compras pasadas.
8.3. Cierre del Servicio
Si decidiéramos cerrar el Servicio, lo anunciaremos con al menos 60 días de antelación e intentaremos ofrecer una vía razonable para descargar tus datos personales conforme al artículo 20 RGPD.
9. Suspensión y cancelación
9.1. Por tu parte
Puedes cancelar tu cuenta en cualquier momento desde Ajustes o escribiendo a legal@strikerpath.com. La cancelación elimina tus datos en los plazos y términos descritos en la Política de privacidad.
9.2. Por nuestra parte
Podemos suspender o cancelar tu cuenta si:
- Incumples gravemente estos Términos o la Política de privacidad.
- Ejecutas actividades fraudulentas, abusivas o ilegales.
- Hay una orden judicial o administrativa que nos lo requiere.
Cuando la causa lo permita, te avisaremos antes y te daremos plazo para subsanar. En suspensiones por fraude o abuso grave, el aviso puede ser posterior.
10. Garantías
El Servicio se presta tal cual y según disponibilidad ("as is", "as available"). No garantizamos que esté libre de errores, que se ajuste a tus expectativas concretas, ni que los resultados de las simulaciones sean previsibles.
Lo anterior no excluye las garantías legales que correspondan a los consumidores conforme al Real Decreto Legislativo 1/2007.
11. Limitación de responsabilidad
En la medida máxima permitida por la ley, no respondemos de:
- Daños indirectos, lucro cesante, pérdida de datos derivada del uso del Servicio.
- Daños causados por contenido generado por otros usuarios.
- Interrupciones por causas ajenas a nuestro control razonable (cortes de proveedores, ataques de denegación de servicio, fuerza mayor).
Nuestra responsabilidad agregada por cualquier reclamación relacionada con el Servicio queda limitada al mayor de: (i) lo que hayas pagado por el Servicio en los 12 meses anteriores al hecho, o (ii) 50 €.
Estas limitaciones no se aplican a daños por dolo, negligencia grave, ni a derechos irrenunciables que la ley reconozca a los consumidores.
12. Indemnización
Te comprometes a mantenernos indemnes frente a reclamaciones de terceros que tengan su origen en (i) tu incumplimiento de estos Términos, (ii) tu contenido, o (iii) tu uso ilegal del Servicio, en la medida en que la ley permita pactar una cláusula de este tipo entre el prestador y el usuario.
13. Ley aplicable y jurisdicción
Estos Términos se rigen por la ley española. Para cualquier controversia, las partes se someten a los Juzgados y Tribunales del domicilio del consumidor cuando éste resida en España, y a los del titular del Servicio en el resto de los casos. Esta cláusula no priva al consumidor de los derechos que le reconozca su jurisdicción de residencia conforme al Reglamento (UE) 1215/2012.
Para resolución alternativa de litigios online, la Comisión Europea pone a disposición la plataforma ODR: https://ec.europa.eu/consumers/odr.
14. Modificación de los Términos
Podemos modificar estos Términos. Si los cambios son sustanciales, te avisaremos con al menos 15 días de antelación por correo electrónico o desde la propia aplicación. Si continúas usando el Servicio después de la entrada en vigor, se entenderá que aceptas la nueva versión. Si no aceptas, puedes cancelar la cuenta sin penalización.
15. Versiones lingüísticas
Las versiones vinculantes de estos Términos son la versión española y la versión inglesa. Las traducciones a otros idiomas son informativas; en caso de discrepancia, prevalece la versión española.

These Terms govern the use of the Striker Path Service. By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.
1. Service provider
- Holder: Francisco Flores Lucena, individual self-employed professional (autónomo) with tax residence in Spain.
- Tax ID: 32732159P.

- Trade name: Striker Path.
2. Subject matter of the Service
Striker Path is an asynchronous online football progression video game, accessible via web browser and via iOS mobile application (and, when published, Android). The Service is provided "as is" under the terms described herein.
3. User account
3.1. Requirements
To use the Service you need:
- To be at least 16 years old. If you are under 16, you may not register or use the Service.
- A valid email address.
- Acceptance of these Terms and the Privacy Policy.
3.2. Truthfulness
You undertake that the information you provide (email, username, profile data) is truthful. If we detect manifestly false information or impersonation of another person or entity, we may suspend the account.
3.3. Credential safekeeping
You are responsible for keeping your password confidential and for actions performed from your account. If you suspect unauthorized access, write to legal@strikerpath.com.
3.4. One person, one account
Each user may keep a single account. Multiple accounts intended to gain competitive advantages (virtual currency exchange, artificial promotions, evading sanctions) are prohibited and may be canceled without refund.
4. Acceptable conduct
By using the Service you undertake not to:
- Harass, threaten, insult, or defame other users.
- Use discriminatory language based on race, gender, sexual orientation, religion, nationality, or disability.
- Share sexually explicit, violent, illegal content, or content that infringes third-party rights.
- Impersonate another person, brand, or institution.
- Reverse engineer, decompile, or obfuscate the operation of the Service or interfere with its infrastructure.
- Use bots, scripts, automations, client modifications, or exploits to gain advantages not foreseen by the game's rules.
- Trade accounts, virtual currency, or in-game items outside the Service's official channels.
- Collect data from other users without their consent.
Breaching these rules may result in warnings, temporary restrictions, suspensions, or definitive cancellation of the account. The severity of the sanction is proportionate to the conduct and to its repetition.
4.1. Zero tolerance for objectionable content
We do not tolerate objectionable content or abusive behaviour anywhere users can write to each other. Concretely:
- Filtering. Messages, names, club names, and mottos are screened automatically before they are stored, and content matching our blocklist is refused.
- Reporting. Every message and every profile carries a report action. Reports reach our moderation queue immediately.
- Blocking. You can block any player from the message itself. A block is mutual: neither of you can open or write in a conversation with the other, and you stop seeing their messages in shared rooms. You can undo it at any time in Settings → Privacy.
- Our commitment. We review reports of objectionable content and act on them within 24 hours, removing the content and, where warranted, suspending or ejecting the user who posted it.

5. User content
5.1. Your content
You may generate content within the Service: username, character name, avatar configuration, club crest, chat messages, reports, and feedback. You retain ownership of such content.
5.2. License you grant us
So that the Service can function (display your avatar to opponents, propagate your messages, present your club in the league system), you grant us a worldwide, non-exclusive, royalty-free, revocable license to host, copy, display, and distribute such content strictly within the Service and its operational communications. This license terminates when you delete the content or close the account, except as necessary for legal purposes (anti-fraud records, operational backups) and for the strictly necessary period.
5.3. AI-generated content
Some features (AI-generated club crests, facial portraits) employ artificial intelligence models. Output is offered as is, with no guarantee of uniqueness. If you ask us to take down a crest or portrait due to similarity with a brand or person, we will assess it and, where appropriate, remove it.
6. In-Service purchases
6.1. Products
The Service may offer:
- Premium subscription: unlocks additional features while active.
- Virtual currency (gold, gems) and consumables (boosters, cosmetics): they have value exclusively within the game, are not convertible to real money, and cannot be redeemed outside the Service.
6.2. Payment processor
On web, payments are processed via Stripe; on iOS and Android, via Apple App Store / Google Play (orchestrated by RevenueCat). Their additional terms apply.
6.3. Right of withdrawal
Pursuant to Article 103.m of Spanish Royal Legislative Decree 1/2007 (TRLGDCU), when downloading virtual currency or digital content with immediate execution, you waive the right of withdrawal. You will see a notice at purchase confirmation. For subscriptions, you have 14 calendar days from contracting to withdraw, provided you have not started enjoying the contents; if you have accessed premium content during the withdrawal period, it is deemed consumed.
6.4. Refunds
Refunds are handled according to the payment processor's policies (Stripe, Apple, Google). For incidents attributable to Striker Path (erroneous charge, duplicate transaction), write to legal@strikerpath.com within 30 days of the transaction.
6.5. Catalog and price changes
We may modify the catalog, prices, and offers. Changes do not affect transactions already completed. If we raise the price of an active subscription, we will give you at least 30 days' prior notice and you will have the right to cancel before renewal.
7. Intellectual property
7.1. Ours
Except for user content and third-party software components under their respective licenses, all elements of the Service (code, design, illustrations, animations, music, brand, name, slogan) are the property of Striker Path or those who have licensed them to the Service. We grant you no rights to them beyond the use necessary to enjoy the Service under these Terms.
7.2. Third-party
If you believe content within the Service infringes your intellectual or industrial property rights, write to legal@strikerpath.com identifying the work, your ownership, and the content complained of.
8. Service availability and modifications
8.1. Availability
We make reasonable efforts to keep the Service available continuously, but we do not warrant any specific availability level. Planned (maintenance) or unplanned (failures, attacks, force majeure) interruptions may occur.
8.2. Modifications
The Service is under active evolution. We may add, modify, or retire features, adjust game balance (statistics, rewards, difficulty), and rewrite parts of the experience. These changes are part of the nature of an evolving service and do not entitle you to a refund of past purchases.
8.3. Service shutdown
If we decide to shut down the Service, we will announce it at least 60 days in advance and will endeavor to offer a reasonable means to download your personal data under Article 20 GDPR.
9. Suspension and cancellation
9.1. By you
You may cancel your account at any time from Settings or by writing to legal@strikerpath.com. Cancellation deletes your data within the timeframes and terms described in the Privacy Policy.
9.2. By us
We may suspend or cancel your account if:
- You materially breach these Terms or the Privacy Policy.
- You engage in fraudulent, abusive, or illegal activity.
- A judicial or administrative order requires us to do so.
Where the cause permits, we will give you advance notice and an opportunity to remedy. For suspensions due to fraud or serious abuse, notice may be subsequent.
10. Warranties
The Service is provided "as is" and "as available". We do not warrant that it will be error-free, that it will meet your specific expectations, or that the outcomes of simulations will be predictable.
The above does not exclude legal warranties applicable to consumers under Spanish Royal Legislative Decree 1/2007.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for:
- Indirect damages, lost profits, or data loss arising from use of the Service.
- Damages caused by content generated by other users.
- Interruptions due to causes beyond our reasonable control (provider outages, denial-of-service attacks, force majeure).
Our aggregate liability for any claim related to the Service is limited to the greater of: (i) what you have paid for the Service in the 12 months prior to the event, or (ii) €50.
These limitations do not apply to damages caused by willful misconduct, gross negligence, or to non-waivable rights granted to consumers by law.
12. Indemnification
You undertake to hold us harmless from third-party claims arising out of (i) your breach of these Terms, (ii) your content, or (iii) your illegal use of the Service, to the extent the law permits such a clause between provider and user.
13. Governing law and jurisdiction
These Terms are governed by Spanish law. For any dispute, the parties submit to the courts of the consumer's domicile when the consumer resides in Spain, and to those of the Service's holder otherwise. This clause does not deprive consumers of rights granted by their jurisdiction of residence under Regulation (EU) 1215/2012.

14. Modification of the Terms
We may modify these Terms. For substantial changes, we will give you at least 15 days' prior notice via email or in-app. If you continue to use the Service after entry into force, you are deemed to accept the new version. If you do not accept, you may cancel the account without penalty.
15. Language versions
The binding versions of these Terms are the Spanish and English versions. Translations into other languages are informative; in case of discrepancy, the Spanish version prevails.
